Checking a Property Agent's K-RERA Registration Before You Deal in Bangalore

Often it is an agent who makes the first pitch to a Bangalore buyer, long before any meeting with the developer. Karnataka law expects that agent to carry a K-RERA registration and to print the number on each deal. What follows explains who must register, a simple online lookup, the limits of what it shows and the checks that stay with you.

Who the Act Treats as an Agent

RERA, passed in 2016, defines the word generously. Anyone negotiating, or acting on behalf of someone else, in the sale of land, flats or buildings, and receiving a fee or a commission for it, qualifies. So does anyone who puts sellers in touch with buyers through any channel, and the Act names dealers, brokers and middlemen outright.

Legal form makes no difference. Solo brokers, partnerships, companies, channel partners of builders and online platforms taking a cut of sales all count as agents. Staff on a developer's own payroll act for the promoter, so the project's registration already covers them.

The Registration Rule in Section 9

Under section 9, an agent must register with the Authority before arranging any sale or purchase in a registered project. A number is issued, and it has to be quoted in each transaction the agent facilitates. Violated conditions, or a registration secured through fraud or a false statement, can lead to suspension or revocation by the Authority.

In Karnataka, individuals pay a registration charge of Rs. 25,000, while every other kind of applicant pays Rs. 2 Lakhs. A certificate is valid for five years, so renewal has to be filed ahead of the end date. The rule covers projects registered with RERA only, which leaves brokers who handle rentals alone outside it.

A Quick Online Lookup

It costs nothing and takes a few minutes. Run it before you share papers or pay a token.

  1. Ask for the K-RERA number plus the name exactly as it appears on the certificate.
  2. Go to the Karnataka RERA portal, then to its registered-agent search.
  3. Type in the number, or the name when the number is missing.
  4. Line up the record's name, registrant type and address against the visiting card, letterhead and receipt.
  5. Read the validity dates and make sure your transaction date falls within them.
  6. Look for the number on the agent's ads, messages and booking forms.
  7. Search the project too, and confirm it has a registration number of its own.

On the register, agent numbers contain AG and project numbers contain PR. If an agent cites a project's number to prove personal registration, the real question is still unanswered. Where a firm holds the registration, confirm that the person in front of you works for it.

What a Registered Agent Owes You

The duties in section 10 are the real value of registration for a buyer.

  • Refusing to help close a deal in a project that should have been registered and was not
  • Maintaining the prescribed accounts, records and papers
  • Avoiding false claims on a project's standard or quality, or on approvals and affiliations that are not real
  • Refusing to allow adverts for services that will never be delivered
  • Helping the buyer get every item of information and every document due at booking

A section 31 complaint may be lodged against an agent, just as against a promoter. With the number, there is no doubt who the complaint names.

Where the Check Ends

A match tells you the agent is entered in the K-RERA register and is bound by section 10, and it gives you a name for any complaint. It cannot grade the agent's expertise, the advice given or the quality of the building.

You still need to verify the project on your own. That means its registration and stated completion date, the title documents, sanctions, the price on the developer's cost sheet, and the agreement for sale. Whatever an agent says is worth only as much as these records back it.

Penalty for Working Without Registration

A broker operating unregistered, or breaching section 10, is liable under section 62 for Rs. 10,000 a day of default. The cap is 5% of the cost of the land, flat or building sold through the agent. Section 65 adds another penalty for ignoring the Authority's orders.

For buyers the damage is practical. An unregistered agent has no file with the regulator, so promises are hard to chase. If a number is refused, go to the developer directly, or find another agent.

Protecting Your Money and Promises

Money and spoken assurances cause most agent disputes. These habits keep both under control.

  • Transfer the booking amount to the promoter's project bank account, never an agent's personal one
  • Insist that the developer itself issues the receipt and allotment letter against each payment
  • Get the developer to confirm in writing any promise about price, floor, view, discount or possession timing
  • Put your agent's fee, if you owe one, on paper; in new projects commission is normally the developer's cost
  • Save the agent's emails and messages as evidence if a claim turns false

Resale is different. Homes in older buildings generally fall outside RERA, so the registration of a broker may not be relevant. Safety there rests on a title check, a proper sale agreement and bank payments.

Three Questions for the First Meeting

Request three things: the K-RERA number of the agent, the registration numbers of the projects on show, and confirmation that the developer has authorised the agent to sell it. A professional answers at once and emails the details.

On this site we market projects as a partner, and each receipt and agreement comes from the developer. Questions on registration details for a project can go through the contact page, and our team is introduced separately.
