NRI Guide: Using a PoA to Buy a Home in Bangalore

Plenty of Non-Resident Indians close a Bangalore home deal without boarding a flight, by giving a trusted person in India legal authority to act for them. This guide covers what that authority achieves, who should hold it, how it is worded, attested abroad and stamped in Karnataka. It ends with the loan angle, common slip-ups and the steps to wind the arrangement up.

Is One Really Necessary?

Sometimes the answer is no. A buyer who can fly to Bangalore for the sale agreement, the deed registration and the loan paperwork needs no representative at all. For everyone else, a PoA replaces repeated trips and lets the purchase move at the developer's pace.

The document is a written authority created under the 1882 statute on powers of attorney. The buyer is the principal, and the person named in India is the attorney or agent. Whatever that agent does inside the stated limits binds the buyer exactly as a personal signature would.

What the Agent Actually Does

In a typical purchase, the agent signs the sale agreement, goes to the registration office to register the sale deed, and receives possession. Ownership never leaves the buyer, and the agent acquires nothing in the home. Buying from a seller who relies on a general PoA alone is a separate topic, with title risks of its own.

Whom to Appoint

An agent signs binding papers and handles funds belonging to the buyer, so trust outweighs everything else. Parents, siblings and other close relatives living in or near Bangalore are the usual picks. Calls to visit the developer, the bank and the registration office tend to arrive at short notice, which means free time is a must.

A person standing to gain from the deal is a weak candidate. A developer's employee or a commission-paid broker wants the deal closed, which can pull against the buyer's interests. When no relative can step in, a lawyer hired directly by the buyer works well.

Narrow Beats Broad

A general PoA hands over a wide spread of acts touching many properties and bank dealings. A special PoA is limited to a single property, with a defined list of permitted acts. Where just one purchase in Bangalore is involved, the special type is the better fit.

Registration offices, developers and banks hunt for the precise act in the wording, so a tightly drawn document is cleared faster. It also caps the loss if things sour with the agent. Leave out any power the purchase has no use for.

Drafting: Powers and Safeguards

Every act the agent may perform should be written in everyday language. A normal purchase needs the following.

  • Signing the agreement for sale, plus the allotment letter and booking form
  • Executing the deed of sale in the buyer's favour and lodging it for registration
  • Making payments (duty, fees, instalments) out of an account held by the buyer
  • Taking over the home, signing handover documents and collecting the originals
  • Applying for khata, utility connections and the tax record under the buyer's name
  • Signing loan documents and handing the title deeds to the lender, if there is a loan

Describe the property fully. An apartment needs the project, tower and flat number; a plot needs taluk, village and survey number. The agent appears with PAN, address and full name. Forbid handing the powers on to a third party, so control stays where the buyer put it.

Two more clauses give protection. The first fixes a finish line, either a calendar date or the point when the purchase is complete. A second clause records that the buyer may pull back the authority whenever required, through written notice.

Signing and Attesting Overseas

For a PoA that supports registration of a deed, the Registration Act, 1908 supplies the test. Section 33 requires a principal who is outside India to sign in front of one of several officers: a notary public, a court, a judge, a magistrate, or a consul or vice-consul of India. That officer then authenticates it.

Two routes are common among buyers abroad:

  • Appearing at an Indian mission abroad, where a consular officer attests the signature
  • Signing in front of a notary where the buyer lives, then securing an apostille if that country is a Hague Apostille Convention member

Australia, India, the United Kingdom and the United States are all parties to that convention. Where the country is outside it, the consulate is the way. Each consulate sets its own list, often a passport, the draft, photographs and witnesses, so check it before reserving a slot.

Stamping in Karnataka

Signing abroad does not attract Indian duty on the day. Karnataka's 1957 stamp law lets such a document be stamped inside a three-month period counted from its first arrival in India. The period runs from the day the original lands with the agent, and a courier receipt proves the date.

The agent carries the original to the office of the District Registrar, which examines it and collects the duty. The 2023 amendment to the Karnataka Stamp Act, applicable from 3 February 2024, now charges Rs. 500 on a simple PoA where it earlier charged Rs. 100. Late papers are regarded as unstamped, and acceptance comes only after paying a penalty.

All of that is separate from the price of the home. When the price is over Rs. 45 Lakhs, duty is 5% (5.6% after cess and surcharge) and registration costs 2%. The agent pays both when registering the sale deed, using money the buyer remits.

Bank Loans and Remittances

Indian lenders recognise a PoA for loan paperwork only when it names those acts. Some insist on their own text, so show the draft to the chosen bank before anyone signs abroad. A single document for both purchase and loan spares an extra attestation.

Money flows through banking channels, whether remitted from abroad or sent from an FCNR, NRE or NRO account. The agent may operate payments, but the funds belong to the buyer throughout. Our NRI page shows how we help overseas buyers, and the EMI calculator estimates monthly instalments.

Slip-Ups That Cause Trouble

Most difficulties trace back to a few avoidable errors made at the drafting stage.

  • Granting sweeping powers where a property-specific grant would have served
  • Relying on a foreign notary alone, skipping the apostille or consular attestation Indian offices expect
  • Allowing the three-month stamping window to lapse after the paper arrives
  • Choosing an agent who is paid on commission or has another stake in the sale
  • Forgetting loan powers, a closing date or the ban on delegation

Winding It Up

The authority lapses when its purpose is achieved or its closing date comes round. It also ends if the buyer dies, though the buyer can cancel sooner by signing a revocation deed. A copy goes to the agent and to every office holding the original's copy.

A PoA that was registered is cancelled by a revocation registered at that same office. Send copies to the developer, the bank and the housing society as well. Taking the original back from the agent closes the matter.

Treat this as general guidance. Have a Karnataka lawyer prepare the PoA and verify the duty payable on its precise terms.

Frequently Asked Questions

Is a PoA compulsory for an NRI buying in Bangalore?+
Only when the buyer will be absent. Someone able to visit for the agreement, registration and loan formalities can do without. Buyers overseas usually name an agent for these tasks.
Where should an NRI sign a PoA that will be used in India?+
In front of a consular officer at an Indian mission abroad, or in front of a notary abroad with an apostille added, where the Hague Apostille Convention applies. The Registration Act, 1908 treats a notary's or an Indian consul's authentication as valid.
What is the deadline for stamping a foreign-signed PoA in Karnataka?+
Three months from the date it first reaches India. The agent presents the original to the District Registrar and pays there.
Is a special or a general PoA better for an NRI purchase?+
A special one. It names a single property and the permitted acts. Registration offices, developers and banks find that easier to accept, and it reduces scope for misuse.
What is the way to cancel a PoA?+
By a revocation deed in writing, delivered to the agent, plus any developer, bank or office holding a copy. A registered document is cancelled by a revocation registered at the same office.
