Home Loan Paid Off? The RBI Deadline for Getting Property Papers Back

Paying off the last EMI feels like the end of a home loan, but the borrower's title papers are still sitting in a lender's vault. Until December 2023 there was no firm deadline for returning them. A rule from the central bank (the RBI) now sets one, at 30 days, and attaches a daily penalty. The sections below answer the questions borrowers in Bangalore ask most often about getting the papers back.
How Long Can the Lender Keep the Papers?
A month is the limit, counted from the day the loan is repaid or settled in full. The RBI notified this on 13 September 2023, and it governs every case where papers became due after the end of November 2023.
When the loan began is irrelevant, so one that started in 2010 and ends in 2026 qualifies. The same 30 days apply to cancelling any charge the lender registered on the asset, movable or immovable.
Which Lenders Must Follow It?
The RBI counts home loans as personal loans, so they fall inside the rule. A wide set of lenders is bound:
- Commercial banks, including regional rural banks and small finance ones
- Co-operative banks in the urban, state and district tiers
- Housing finance companies and other non-banking finance companies
- Asset reconstruction firms
So nearly every lender that a purchaser in Bangalore deals with must comply. The duty flows from regulation, so it stands even if the loan agreement never mentions it.
What Exactly Has to Be Returned?
Two tasks must be finished inside the 30 days. The lender hands back every original it took as security, and it takes its charge off the public record.
The originals
The inventory issued at disbursement is the benchmark, and every item should be ticked against it. A file on a flat commonly holds:
- The registered sale deed, plus the agreement of sale if the flat was under construction when bought
- Older title deeds in the case of a resale
- Allotment and possession letters
- Receipts for payments made, and the no-objection certificate from the builder
- Society or association documents, where they were left with the lender
The charge
In Karnataka a home loan is usually secured by leaving the title deeds with the lender, which is noted at the sub-registrar through a memorandum. A second record exists on CERSAI, the national registry for security interests. On closure, the sub-registrar should release the mortgage and the CERSAI record should show it as satisfied.
A charge left on record leaves a fully paid home appearing to be under a mortgage. It is visible in the encumbrance certificate and can hold up a later sale or fresh borrowing.
Where Can Borrowers Pick Them Up?
Collection is at the borrower's choice of place. It can be the branch where the loan account is held or another office of the lender that keeps the papers, a help to anyone who has moved across the city since taking the loan.
A sanction letter issued from 1 December 2023 onwards has to state the time and place of return. Holders of newer loans should read theirs for those terms.
What If the Lender Is Late?
A lender that overshoots the deadline must tell the borrower why. If the fault is the lender's, it pays Rs. 5,000 for every day until the papers return, and an identical sum is due if it is slow to file for clearing the charge.
Other remedies stay open. A complaint goes first to the lender's own grievance officer. When a bank or NBFC leaves it unresolved for 30 days, the RBI Ombudsman can be approached, while the National Housing Bank is the next step for housing finance companies.
What If Papers Are Lost?
Central storage rooms sometimes misplace files. If originals are lost or damaged, wholly or partly, the lender must assist the borrower in obtaining duplicates or certified copies, with the lender paying.
The lender then gets 30 additional days for the work, so payment begins on day 61. For a registered deed, the certified copy is issued by the office of registration. Borrowers do well to keep scans of everything they hand over.
What If the Borrower Has Passed Away?
The directions deal with a borrower's death too, whether the sole borrower or all joint borrowers. Each lender needs a settled procedure for giving the originals to the legal heirs, published on its website beside its other customer policies.
A Closing Routine
Closure goes smoothly when it is run to a calendar. This sequence keeps the count of 30 days unambiguous:
- Obtain a written closure statement and pay exactly what it says
- Retain proof of the last payment and its date, because the count starts there
- Request the originals in writing, naming the collection branch
- Match every returned paper to the disbursement list
- Obtain the no-dues certificate, stating that the loan is shut with nothing payable
- Verify that the mortgage was released by the sub-registrar and on CERSAI
- Request a new encumbrance certificate and check that the lender's entry has been closed
- Read the credit report a month or two later and look for the loan shown as closed
